We share data only with trusted service providers necessary to operate our business:

• Hotels / accommodation providers – to confirm reservations
• Booking platforms – to process bookings
• Payment processors (e.g., Stripe, PayPal) – to securely handle payments
• Google Workspace – for email and document management
• Formspree – for contact-form submissions
• Cloudflare, Inc. – for website performance, content delivery, and security. Cloudflare does not receive travel or payment details; only technical data such as IP addresses or browser information.

5. Legal Basis for Processing (EU/EEA)

For clients in the EEA, we rely on:

• Art. 6(1)(b) GDPR – performance of a contract
• Art. 6(1)(f) GDPR – legitimate interests (service quality, communication)
• Art. 6(1)(c) GDPR – legal obligations

Sensitive data, such as accessibility requests, are processed only with explicit consent (Art. 9(2)(a) GDPR).

6. Data Retention

We retain booking, payment, and communication records for 7 years to comply with legal, accounting, and tax obligations. After this period, data is securely deleted or anonymized.

We may transfer personal data outside your country, including the U.S., under appropriate safeguards:

• EEA/UK: Standard Contractual Clauses (SCCs) for data transfers
• Payment data: transferred to payment processors as required

These Terms & Conditions (“Terms”) govern the use of services provided by Pointsvisor, DBA of NXTI One Ventures LLC (“we,” “our,” “us”). By using our services or making a booking, you agree to these Terms.

2. Scope of Services

• We act solely as an intermediary between you and hotels worldwide.
• We provide information on hotels, rates, and availability, and assist with bookings, but do not operate or manage hotels.
• You pay the hotel directly (or via our authorized payment processors, if applicable).
• Any services, amenities, or benefits offered by the hotel are provided by the hotel, and we do not guarantee them.

3. Booking Policies

• All bookings are subject to hotel availability.
• Confirmed bookings are subject to the hotel’s terms, policies, and rules.
• A booking is considered confirmed when we send you a booking confirmation via email or other communication.
• Any special requests or outlined benefits (e.g., loyalty program perks, room upgrades, included amenities) are not guaranteed unless confirmed by the hotel.
• Prices, taxes, and fees are subject to change until the booking is confirmed.

4. Payment Terms

• Most of the time, you will pay the hotel directly using the payment methods accepted by the hotel.
• In cases where we facilitate payment on your behalf, payments are processed securely through authorized payment providers (e.g., Stripe, PayPal).
• By providing payment information, you authorize us or the hotel to charge the total amount for your reservation.
• You are responsible for ensuring your payment information is accurate and valid.
• We do not store full credit card information beyond what is necessary for bookings and compliance purposes.

5. Cancellations & Refunds (Hotels)

• Hotel cancellation policies vary; please review the specific hotel’s policy at the time of booking.
• You are responsible for adhering to the hotel’s cancellation policy.
• To ensure timely processing of cancellations, you must notify us at least 72 hours prior to the hotel’s cancellation deadline.
• If you cancel within 72 hours of the hotel’s deadline but still before the hotel’s cut-off:
  • Contact the hotel directly to complete the cancellation.
  • Notify us afterward so we can update your booking record.
• Refunds, if applicable, are processed in accordance with the hotel’s policy and payment processor rules.
• We are not responsible for refunds or cancellations once the hotel has confirmed your reservation, except as required by applicable law.
• Regional note: Nothing in these Terms limits your statutory rights under local consumer protection laws (e.g., EU/UK Consumer Rights Directive, Australian Consumer Law, Canadian Consumer Protection Acts, Brazil’s CDC).

6. Modifications

• Any request to modify a booking (dates, guests, or room type) is subject to hotel approval and availability.
• Additional charges may apply for modifications.

7. Liability

• As an intermediary, we are not liable for the acts, omissions, or errors of hotels or third-party service providers.
• We are not responsible for:
  • Hotel service failures, room conditions, or amenities
  • Travel delays or disruptions
  • Personal injury, loss, or property damage occurring at the hotel
  • Indirect, incidental, or consequential damages, including loss of income or missed travel connections
• We do not guarantee the accuracy, completeness, or reliability of any third-party information or services.
• Our liability is limited to the fees you paid us for our intermediary services, to the extent permitted by law.
• Nothing in these Terms limits liability that cannot be excluded or restricted under applicable law.

8. Force Majeure

We are not liable for any failure or delay in performing services due to circumstances beyond our reasonable control, including natural disasters, strikes, government actions, pandemics, or technology failures.

9. Privacy & Data Protection

• Your personal data is handled according to our Terms of Service and Privacy Policy.
• By using our services, you consent to our collection and processing of personal information, including cross-border transfers where applicable.
• Regional note: We comply with major data protection laws, including GDPR (EU/UK), CCPA/CPRA (California, USA), LGPD (Brazil), and Australian Privacy Principles.
